Hominy man pleads guilty to murder in shooting death
Steven Thompson Keeling, 48, admitted that he fatally shot Edward W. "Butch" Brown with a semiautomatic assault weapon at Brown's residence Jan. 17. Brown, 59, died at the scene.
The property is in "Indian Country," thus establishing federal jurisdiction for prosecution of the crime.
Keeling admitted that he shot Brown "deliberately and intentionally" and with "malice aforethought." He did not comment on his motivation for the killing.
Keeling had been indicted on a first-degree murder charge, but he pleaded guilty to a second-degree charge filed earlier Thursday by the U.S. Attorney's Office.
Acting U.S. Attorney Scott Woodward said a key difference between the two crimes is the premeditation element found in first-degree murder. He said the circumstances of the killing played a role in the charging decision.
Keeling's plea agreement says the 25-year sentence is actually more than what would be called for under federal guidelines for second-degree murder.
"An upward departure is reasonable based upon the aggravated nature of uncharged misconduct, that is, the discharging of a semiautomatic assault weapon during the commission of a crime of violence," according to the document.
Among the reasons Assistant U.S. Attorney Clinton Johnson gave for the prosecution's agreeing to a 25-year sentence for the homicide were Keeling's age, a desire to avoid putting witnesses through the ordeal of testifying, and the fact that Keeling still faces state court charges connected to the same incident.
A woman named LeAnn Mitchell was also shot outside Brown's home. She survived the assault and fled into a wooded area, where she called 911 on her cellular phone.
Keeling was charged in January in Tulsa County District Court with the first-degree murder of Brown, shooting Mitchell with an intent to kill and possessing a firearm as a felon.
At a prosecutor's request, a state court judge dismissed the Tulsa County murder count on March 30, based on the federal prosecution.
A preliminary hearing is scheduled for July 29 on the remaining two state charges. The federal charges do not address the shooting of Mitchell.
In the federal case Thursday, U.S. District Judge Gregory Frizzell said he would defer finding Keeling guilty until after he has reviewed a presentence investigation report that will be produced by the U.S. Probation Office.

Hominy is an ingredient that has really surprised me. When I first used it a few years ago, I wasn’t sure I’d like it, not to mention what the rest of the family would think of it. But we learned we loved it! It’s interesting texture and flavor ended up being a winner with all of us. Since then, I’ve used it in several different soups and stews and it always adds a great textural interest that we all enjoy.
But until now, hominy has always just been an interesting addition and never the star attraction. I wanted to change that and decided I could come up with a fun hominy-based side dish to go along with tacos. It turned out really well and we all enjoyed it. The original side dish was perfect with our taco dinner and the leftovers made a great side along with eggs and bacon for breakfast.
Cheesy Hominy Casserole
1 c. water 1 1/2 t. salt 1 1/2 c. corn meal 1/2 t. cumin 1/2 t. black pepper 1 15 oz. can hominy, drained 1 1/2 c. shredded Colby-Jack cheese, divided1. Bring water to a boil. Stir in salt and corn meal. Remove from heat and whisk until smooth, about 1 – 2 minutes. Stir in cumin, pepper, hominy and 1 c. shredded cheese.
2. Transfer to a small casserole dish and top with remaining cheese. Bake at 350 degrees for about 15 minutes, until cheese is fully melted and the edges are just turning brown.
There are a few options here – if you like mushier, you can just serve it straight from the pan or if you’d like it to have a more “set” consistency, you can let it bake longer.
